You i Labs, Inc. (hereinafter referred to as “You.i”) has designed and developed the proprietary software known as the You.i Engine One™ (hereinafter referred to as the “You.i Software”).

To provide you with You.i Software and the related services, including the professional services listed at:  (the “Services”) effectively, we collect certain specific Personal Information (as defined below) from you, and we also automatically collect information and data relating to the usage of our Services by all of our users, including you. Because we are committed to protecting your privacy rights and the Personal Information you provide to us, we have developed this Privacy Policy. It explains how we will protect your Personal Information and how we will use and share it.

This Privacy Policy also governs the collection of Personal Information from individuals who visit our website at (the “Website”) or otherwise make inquiries to You.i.

This policy is concerned with the protection of only your Personal Information. Personal Information means any information about an identifiable individual, or information that could be reasonably used to identify an individual, and may include your name, income, personal opinion, interests, contact information, identification numbers, user IDs, and passwords. Under the laws of some jurisdictions, in a business context, Personal Information may include business contact information such as  name, job title, business address, business email address, or business telephone number of any employee in an organization.

This Privacy Policy may change from time to time to reflect You.i’s internal needs, customer feedback, or changes in applicable privacy legislation. You.i will post all such changes on our Website.

This Privacy Policy does not apply to the practices of any third-party organization, including those of our customers who use the Software to make available their own products and services. Our customers are solely responsible for ensuring that they have obtained the necessary authorizations and consents for any Personal Information they collect, use and/or disclose.

NOTE: The You.i Software and Services are not intended for children under the age of 13. We do not knowingly collect or maintain any Personal Information or non-personally-identifiable information from anyone under the age of 13, nor is any part of our Website, You.i Software, or Services directed to children under the age of 13. We will close any accounts used exclusively by such children and will remove and/or delete any Personal Information we believe was submitted by any child under the age of 13. 


  1. Collecting Personal Information

To use the Software and Services provided by You.i, you will be required to provide specific information about yourself such as your name, address, and telephone number. We will always inform you when we need Personal Information  and we will keep this information in strict confidence. Additionally, you may, on occasion, voluntarily provide You.i with information that can be classified as Personal Information. All such Personal Information will be stored and maintained in accordance with this Privacy Policy.

We collect Personal Information about you in the following ways:

Automatically by You.i’s Software and Services
Certain aspects of You.i’s Software and Services contain features that automatically collect information from users, such as device types, viewing times, usage statistics, and other tracking information. In particular, You.i collects this information about end users of our customers who use Roku devices to stream videos. Although this information will not necessarily identify you personally, it nevertheless provides certain information about you, and we therefore treat it as Personal Information. 

You.i customers and prospective customers

You.i collects certain user Personal Information from our customers and customer contacts. In this case, You.i typically collects the individual’s name, title, e-mail address, and other contact info (office telephone number, cell number, etc.) as well as wire payment information. This information is used for administering our customer contracts, account billing, and providing Services to our customers.

You.i suppliers and partners

You.i collects contact information of individuals who work for our suppliers and other partners in order to communicate with those parties and otherwise conduct business.

You contact You.i directly
When you contact any You.i employee by telephone, e-mail, in person, or through our Website, You.i will collect any Personal Information your provided in order to address your inquiry.

You respond to communications from You.i
From time to time, You.i may invite you to provide us with information for specific purposes. We may ask for this information through feedback features on our Website or we may send e-mail inviting feedback or offering products and Services; or we may ask you for information concerning support of our products or Services. Your response to these communications may require you to submit Personal Information and opinions, which You.i may use to improve our products and Services.

Third-party collection of your information
Due to the nature of the Services provided by You.i, third parties may collect information from you through the use of software applications or websites that are accessed by you through the Services. These applications may separately access, and allow a third party to view your identifiable information such as your name, your user ID, your mobile device ID, or other information such as what you are watching during any given session and any cookies that you may previously have installed or that were installed for you by a third-party software application or website. Additionally, these applications may ask you to provide additional information directly to third parties. Third-party products or services provided through these applications are not owned or controlled by You.i and are governed by the third party’s terms and conditions and/or privacy policy. You are encouraged to read the terms and other policies published by such third parties on their websites or otherwise.

When you apply for a job with us

If you apply to for a job at You.i, we will use the Personal Information you provide to Youi only to consider your application as part of our review process and we generally retain this information after a decision has been made, unless we are asked not to retain the information. The Personal Information submitted by successful candidates will be retained in our employee records for future consideration in accordance with our standard practices.

Use of Cookies
Use of You.i’s Website and/or Software may result in the collection of technical information such as your computer’s IP address, operating system, browser name/version, the referring web page, requested page, date/time, and sometimes a “cookie” (which can be disabled using your browser preferences); such information is used to help us understand the overall usage pattern of our Website and Software.

– provide and deliver the Services and features you request, process and complete transactions, and send you related information, including confirmations and invoices; 

– respond to comments, questions, and requests and provide customer service and support;

– communicate with you about services, features, surveys,  offers, events, and provide other news or information about us and our select partners;

– investigate and prevent fraudulent transactions, unauthorized access to the Services, and other illegal activities;

– personalize content and features on the Website that match your interests and preferences or otherwise customize your experience;

– monitor and analyze general trends, usage, and activities in connection with the Software and Services for marketing or advertising purposes; and 

– for other purposes which we will notify you about and seek your consent.

Subject to any exceptions stated in this Privacy Policy, should You.i collect any of your Personal Information, we will follow these practices regarding the distribution of that information.

Your Personal Information is always protected
You.i uses reasonable precautions to protect your Personal Information and store it securely. Access to your Personal Information is restricted to those personnel who need it, and You.i takes reasonable steps to prevent the unauthorized use or disclosure of your Personal Information.

You.i may combine your Personal Information with other information into an aggregate form, so your information no longer personally identifies you. We may then disclose the aggregate information to third parties, such as our customers and partners, so they can obtain an overall picture of You.i’s products, services, customer sectors, and/or usage patterns.

Disclosure of Personal Information in accordance with applicable laws

You.i provides your information to third parties only for purposes to which you have consented, and we require such third parties to keep your information confidential.

In a few situations, You.i may be required to disclose your information without your prior consent. For example, You.i may disclose your information if we are required to do so by law or if we believe in good faith that such disclosure is necessary to:

– comply with law or legal process;

– protect and defend our rights and property or the rights and property of a third party;

– protect against misuse or unauthorized use of any of You.i’s products, software, services, or other proprietary materials; and

– protect the personal safety of any person.

In addition, if the business of You.i (or substantially all of our assets) are acquired by a third party, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law. This does not affect the protection of your information under this Privacy Policy.

You.i will always try to provide you with prior notice of such disclosure; however, such notice may not always be possible or reasonable given the circumstances.

Third-party service providers and sub-processors

Additionally, the nature of the Services provided requires the routine use of your information in the provision of the Services. Your Personal Information will be used only to the limited extent necessary to provide the Services that you have requested, and may include the following uses:

– to allow third-party suppliers, vendors, contractors, and other parties to provide products and services to us or to you or to otherwise act on our behalf (this may include, without limitation, our authorization of such third parties to e-mail our users regarding updates, surveys, and other inquiries regarding their experience with our Software and Service); and

Storage of Personal Information

We use servers located on our premises as well as cloud services hosted by third-party service providers whose servers are located in Canada, the United States and Australia (as indicated above).  Accordingly, your Personal Information may be available to government and/or law enforcement agencies in Canada, the United States and Australia, and may be accessed by these entities pursuant to a lawful order, irrespective of the safeguards we have implemented to protect your Personal Information.


  1. Maintaining your Personal Information

You.i has established the following practices regarding the maintenance of your Personal Information.

You can request access to your Personal Information at any time
If, for any reason, you wish to review your Personal Information that You.i has in its possession, you can contact our Privacy Officer, who will be pleased to provide you with a description of all your Personal Information that You.i has on file.

You can request changes to your Personal Information at any time
Sometimes, it will be necessary for you to update your Personal Information that You.i has on file. 

If you wish to make any changes or corrections to your Personal Information, please contact our Privacy Officer, who will implement the changes. This will help us ensure that our records are always up-to-date.

You can opt out of marketing communications at any time
Additionally, you always have the choice of whether or not you wish to receive marketing communications —such e-mail updates—from You.i. 

If you do choose to opt out of communications respecting Software and/or Services provided by You.i, you may still receive electronic communications that are necessary for the Software or Services, such as updates or warnings. 

You can request that your Personal Information be destroyed at any time
A situation may arise where you desire to have all of your Personal Information that is contained in You.i’s records deleted or destroyed. If this is what you wish, please contact our Privacy Officer, who will take care of removing your Personal Information from all You.i’s records. However, there may be situations where we are obligated to retain one archival copy of your information to allow us to comply with laws or respond to legal processes.  To the extent any of your Personal Information is contained within Youi’s standard backup copies automatically created by Youi’s IT systems, such Personal Information will be deleted as the applicable daily, weekly, monthly or other backups are deleted in accordance with Youi’s standard deletion policies for such backups. We will inform you of all such situations, and will use your retained Personal Information only to the limited extent necessary to comply with such laws or respond to legal processes.


  1. Residents of the European Economic Area (“EEA”)

Some of You.i’s customers and their end users may be located in the European Economic Area (“EEA”). To the extent that the European Union’s General Data Protection Regulation (“GDPR”) is deemed to apply to You.i’s practices, the following terms shall apply:

Transfers of any personal data (as that term is defined under the GDPR) of residents of the EEA are made in accordance with permitted legal measures under applicable laws. Whenever we transfer personal data out of the EEA, we ensure a similar degree of protection by at least one of the following safeguards:

– The country to which the personal data is being sent has been deemed to provide an adequate level of protection for personal data by the European Commission.

– Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in the EEA.

The legal grounds under which we process personal data of EEA residents are:

– with consent;

– to perform the Services you have requested from us or, upon your request, to take the steps necessary to provide you with such Services; or

– in the furtherance of our legitimate interests in maintaining business relationships and communicating with you as a business contact, about our activities and Services.

Where we process personal data on behalf of our customers, You.i is acting as the “data processor”. In all other cases, You.i is a “data controller”.

Further, individuals located in the EEA have certain rights under European law (including under the GDPR) with respect to personal data, including the right to request access to, obtain, correct, amend, delete, or limit the use of your personal data. Individuals who are located in the EEA and who wish to exercise these rights, should contact us using the contact information above. If the inquiry relates to personal data collected by a third party, such as one of our customers, you should contact such third party.

Individuals also have the right to make complaints to regulatory authorities in respect of our privacy practices.


  1. California Residents

This section provides additional details about the Personal Information we may collect about California consumers and the rights afforded to them under the California Consumer Privacy Act (the “CCPA”), to the extent the CCPA is applicable to You.i.

We collect Personal Information for commercial purposes described above. You.i does not sell (as that term is defined in the CCPA) the Personal Information we collect.  

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of Personal Information we collect (including how we use and disclose this Personal Information), to delete their Personal Information, to opt out of any “sales” of Personal Information that may be occurring, and to not be discriminated against for exercising these rights.

 California consumers may make a request pursuant to their rights under the CCPA by contacting us at the contact information below. We will verify your request using the information associated with your account, if available, including email address. Government identification may be required. Consumers can also designate an authorized agent to exercise these rights on their behalf.

Note that we are not able to provide access to Personal Information that we store on behalf of our customers (in our hosted software service offerings). If you require access or correction of Personal Information collected by our customers, you will need to contact the applicable organization directly.
